Racial Steering Real Estate Broker From City Habitat

It has been brought to my attention that one of the most racially insensitive real Estate Brokers is non other then the senior associate broker from New York City Habit. Her name is Tracey Boudine. Ms. Boudine has been using code words and racial steering tactics for a long time. Some of her tactics may have also run contrary against Civil Rights laws and Fair Housing Laws. For example in this ad she specifically mentions Vox Pop, Cafes, and Bars, but fails to mention any other establishments. While in this ad for a Co-op in Prospect Park Lefferts garden she again mentions all the "new" places but fails to mention any other establishments. This can be deemed a bias ad because if you mention one set of business and not others then it can be construed to be showing a preference for the type of individuals that would frequent such establishments. For example to advertise that an apartment is near a Catholic Church would be discrimination against non catholics. Her advertisements specifically mentions certain business establishment while conveniently leaving out other amenities that lets say a recent family from south America, the Caribbean or someone who is disable and may be interested in. In essence Ms. Boudine is saying we don't want your kind, unless you fit into a specific demographic I'm trying to steer.

That woman is one of the worst. I remember one of her ads a couple of years ago. She was always pushing vox pop. This is not going to be good for this neighborhood in the long run. If people feel like they are not getting a fair shake in the system that's when tension and resentment builds up. She's playing with peoples lives.

I think this is part of the reason that there might be some resentments towards hipsters and yuppies. People feel like they get preferential treatment when they are looking for housing, simply because of their race. It's not their fault though. I just think this type of thinking from people like Tracey Boudine needs to stop. The sooner the better.

Not just Hipsters and Yuppies. Young white College students are preferred when it comes to renting for no reason other then their race. They could be a mass murderer for all they care. Their Credit History, bankruptcies and Minimum Salary requirement are more likely to be overlooked. This is pure racism and will not do anything to solve this problem in the long run. People rant against the yuppies, but it's not their fault. It's people like Tracey Boudin and Jan Rosenberg that are perpetrating this type of racist thinking.
One of the last great institutions of racism is Real Estate. Why do you think perfectly "reasonable" people ask "what type of neighborhood is this?" Would it make any sense to ask your friends the racial breakdown of the company you work for, why should neighborhoods be any different?

Once you start advertising for certain businesses near by then it will raise a red flag. Give me a break Sue. We all know what she meant with those next to Vox Pop and "fabulous cafe" ads. There was even a NY Times article on flatbush and how Vox Pop was an Anchor for more white people to move in. Is it just a coincidence that she uses vox pop in her ad? What if I'm not interest in going to a "fabulous" cafes or Vox Pop? Would I feel comfortable going to a real estate agent like that? Shouldn't all ads be Neutral?
Why are there no posts on the previous thread about volunteers? We need to stop bitching about how we are getting pushed out by racist realtors and give each other a hand up. Don't wait on help from anywhere else because it's not coming. Help someone learn to read so that they can get a decent job, educate their kids who can then open real estate agencies of their own and rent/sell to who ever they damn well please. These "yuppies" and "hipsters" get on my nerves too but of course they will try to steer more of their kind to the area. I don't even want some of my ghetto ass neighbors living nnear me. They don't pick up the trash in front of their house, have old rusty cars in the backyard and driveway, illegally rent out the basement, play loud music, have siding falling off of the house, etc... When my parents first bought their house the neighborhood was still mostly white. The hosues were all well kept. Well as soon as more of us started coming in many of the previously well kept houses now look like shit. Seriously, why is this? Can't blame that on the realtors.

My problem is with these real estate agents who are using illegal tactics which in the long run will do more to divide and create unneeded tension. Why can't they just have a race neutral approach when it comes to advertising and renting? What was done in the past has obviously not worked and yet they continue to behave in the same old patterns. As far as getting "our" own agencies to rent to whom ever "we" want.. you can't fight racism with more racism.It's not a matter of black vs white. It's wrong vs right. I'm pretty sure there are plenty of black real estate agents that discriminate against other races and even whites. That's wrong also. If she did try to sue I'm pretty sure the ACLU would be quick to take on therealflatbush blog as a client. She would also bring more scrutiny to her pass dealings with clients, including the racial breakdown of the people she got apartments for.

Good point. Sue would have to produce documentation reflecting how she provided homes for all people, regardless of race, sex, ethnicity and sexual orientation.
This realtor is well within her right to advertise a neighborhoods ammenities as long as they are not affiliated with or discriminatory toward a protected class under the Fair Housing guidelines. If she advertised that this apartment was near "Temple Beth Elohim, a progressive temple" or walking distance from the "Irish American Cultural Center," she would be in violation. She may even advertise ammenities such as golf courses, eateries, parks etc... The mere mention of The Farm but not mentioning New Neighbor or Golden Crust does not constitute discrimination. Realtors know just how far to push the limits without crossing the line.
She may be skirting around the letter of the law but she is in vialation of the spirit of the law. Courts do take that into account. Especially when it comes to Civil Rights issues in the pass. If you can cite the various News article over the years that portrayed vox pop as an anchor for more white people to move in and she specifically mentions vox pop in a real estate ad then she may have a problem.

I think there might be a case against her mainly because of all the Newspaper articles. The last article on AMNY had a picture galary which had no persons of color in it except for the server. The question would have to arise is What would a reasonable person in a similar situated circumstance believe this ad was for? The reasonable person in a similar situated circumstance in this case would have to be a person who lives in Flatbush or a similar neighborhood with similar venues like vox pop or the farm. What is the prevailing attitude or character of these places? Are they affiliated with a certain group? Would someone (from a protected class) who saw this ad feel uncomfortable or discourage from going to this realtor for an apartment? You will also have to look at other real estate ads in similar situated neighborhoods and see if this is the norm. Do other agents advertise similar venues while leaving out others? Would a reasonable agent in a similar situated circumstance have had advertise in the same way? Or was her ad out of the norm of real estate ads?

flatbushlawstudent, newspapers print what they print, and when it comes to photos they decide for themselves which pictures to include with their stories. The realtor is not responsible for the content of a news article.
Thus, if there is a reason to believe the article conveys a racist bias on the part of the realtor, then the realtor may become a plaintiff in a suit naming the newspaper as the defendant.

In other words, the APARTMENT COMPLEX management engaged in AGE DISCRIMINATION. Of course, this may well have been an attempt to keep out troublemakers. Since the management wants the business to operate profitably, there are lots of reasons to seek the best possible tenants.
On the other hand, the realtor in question works for an agency -- not for a single apartment complex. Hence, she has no reason to violate laws about renting and selling residences.

Go to Carver's website, where you can read all about Carver's intention to serve black customers. Check the photos on Carver's site for racial balance. Check the text. It is a bank that describes itself as being all about the black community.
Try substituting the word "white" wherever you find "African American" or minority and see how it sounds. Does your head explode? Probably not.

I actually dealt directly with Tracy Boudine when I decided to move back to the area. I told her (over the phone) I was interested in living in "western flatbush", so she began pushing apts. near Flatbush Avenue. She had no idea what my race is (white, in fact), but because I used the word "Flatbush" she probably assumed black and then began steering; in fact I was primarily interested in the general area I grew up, i.e. between Ocean Ave. and Coney Island Ave.
However, I still would like to know why Vox Pop keeps getting implicated as somehow "racist" on this blog. I'm not saying it is or isn't - I'm simply requesting clear, hard evidence (despite the fact that a steady stream of, say, 20% of their clientele, is black, and bear in mind they are on the border of Flatbush, one block from Kensington, which has a pretty small black population compared to Flatbush) that Vox Pop somehow engages in or condones racism in any way. Just because a business attracts people more of one race than another doesn't make it racist; else we could call many businesses on Flatbush Avenue "racist" because most customers are black - which would be nonsense, of course. Are the Mexican groceries racist? Or the Dominican hair salons? Of course not. However, those signs that you often see that say "Se renta cuarto"...that's a different story. It is true that "agents" use Vox Pop for various purposes. The most import purpose is keeping an eye on Sander Hicks, the owner. They want to ruin him.
"Agents", as Hicks will tell you, have been operating secretly around him for years, trying to discredit him because he says the Bush Administration was behind 9/11. His sale of books claiming Bush Administration involvement has made him a target of Bush "agents." His personal investigative efforts intouncovering secrets of the Bush Administration have caused the Administration to label him an Enemy of the State.
The "agents" have been trying to destroy his credibility. One of their sleazy tricks involves smearing Vox Pop as a gathering place for racists. Birds of a feather, as is often said. I think Real Estate brokers feel like they can get away with anything. Even the National Realtors Association tells them to follow the letter of the law. The letter of the law is obviously not enough. Any reasonable person can see clearly what these ads are aiming for.
I think people should be free to move were they want without these racial steering practices from real estate agents. In the long run it will be to the benefit of everyone.
Vox Pop is definitely not a racist place. I can't explain as eloquently as the flatbush law student but I agree. What is the general reputation of vox pop to the residents of flatbush. Is it widely known to be frequented more by a certain portion of the residents? I have no doubt that vox pop,connnecticut muffing etc are extremely open to everyone, but the question that the flatbush law student ask was what is the general reputation of these establishments? What do they have in common? If they have certain traits in common, it stops being a coincidence and she might have a problem with Fair Housing Laws.
She is incredibility transparent as to what she is doing. Where is Elliot Spitzer when you need him? The Attorney General's Office should do a probe on these Real Estate Firms.

If the ads and the website are not clear enough, there is the name itself -- Carver. As in George Washington Carver, one of the few black scientists in the history of the world.

Here's the clue. The street names capture the essence of the WASP -- the White Anglo-Saxon Protestant.
Since its creation about a century ago, the neighborhood has proclaimed its whiteness and its identification with British heritage in every way. The effect was extended with the naming of Kensington and Windsor Terrace.

Carver Bank is a bank that aims to serve blacks.
If another bank used the same advertising strategy for serving white customers, YOU would be the first to cry Racism.
Carver was founded to meet a need. There were black city residents seeking loans, but they were not getting loans from most banks. That was a long time ago.
Here's a fact for you. Carver is a public bank -- you can buy stock in Carver. But buying stock in Carver is a bad idea. Why? Becasue the bank is a lousy bank when it comes to building the business.
Carver Bank stock is the worst performing stock of any bank headquartered in NY City. The worst.

I walked down Flatbush Avenue today, from Brooklyn College to Empire Boulevard. There were very few white faces on the street.
New York City is about 25% black, 25% hispanic, 42% white and 8% asian. Brooklyn is less white than the city overall. Flatbush is probably 80% black and hispanic and less than 20% white.
There's no question about which group is in the minority here. Nevertheless, you and a few others are angry about the handful of whites buying homes in a few small neighborhoods.

First, Vox means Voice. And Pop is short for Populi. Populi means People. The phrase is Vox Populi, or Voice of the People. As goofy as Sander Hicks may be, his coffee shop is an expression of his egalitarianism.
Of all the businesses to pick to convey your belief in local racism, you and your like-minded friends found the one without a hint of what you claim. As for women's colleges and men's colleges and giving preferences to applicants based on gender and/or race, well, a private college can do that. A state -- government-supported -- school cannot.
Banks base lending on a borrower's credit worthiness. Over the past couple of years, money was loaned to almost anyone if the borrower intended to buy residential real estate.

I think you made a good point as to what these businesses have in common in all those ads. As a matter of fact anyone who had contact with Tracey Boudine in the past maybe wise to form some kind of class action lawsuit.

Like I said, Flatbush is 80% black and hispanic. It's tough to claim racism drives real estate action when a couple of whites move into the area. Unless you mean anti-white racism.
I think it would be possible to have a class action suit. As long as people who have come in contact with Tracey Boudine can prove bias. From what it looks like it would not be that hard. HUD also does investigations individually so anyone can file a complaint individualy. They can also contact Fair Housing Non Profits like ACORN and they can test for bias before a suit is filed. Similar to what was done with Concoran recently. But the optimal solution would be to sue individually or through a class action against Citi Habitat and other realtors and landlords.
They can also file a complaint with the New York City Human Rights Commission. You just have to call 311. Essentialty from the looks of it, every (BLACK)home seeker or renter in Flatbush (and all of Brooklyn as well), should have their papper work as well as the number to HUD when looking to buy or rent. I think having the address of the building and printing out a copy of the ad would be enough to start an investigation with HUD and NYC HRC.
Getting the name of the real estate agent is also important. By law they(real estate agents, landlords, and their associates) can be criminaly charged for intervering with your right to claim bias in a Fair Housing dispute.
It would be easy to prove the intent of these real estate agencies in light of what is going on right now. I think one of the posters hit it right on the head. What do these places have in common in those ads? Were they just ramdomly picked? If not then Citi Habitat may have a big problem in it's hand.
You would also have to compare her ads for flatbush with her other ads. Are they similar or was it tailored for Flatbush? I look at the Citi Habitat website and her ads for Briton Beach are not that obnoxious. Very troubling

At its core, your argument is based on keeping whites out of Flatbush, an area with a very low white population.

I think there comes a time when you have to stand up for you rights. As far as I'm concern every black person looking for a house or to rent should be arm with the phone number of HUD as well as NYC HRC. Its obvious as to what is going on. Replace a black with a white person every time a black person moves out.

This is outrageous. Those ads are so transparent that it's not even funny. What exactly are our elected officials doing do allow this type of thing to go on? Why can't they just have a race neutral approach to renting everywhere. It's people like Tracey Boudine that has made Brooklyn one of the most segregated places in the country. She is not interested in integration. She just wants to replace blacks with whites. All those people see is race.
The average settlement for a fair housing violation with HUD is $10,000. There is no limit as to how many times one person can file a claim. Discrimination is so rampant in Brooklyn. I'm thinking of trying to test these places for bias and sue them just for the money. Kill two birds with one stone
You can do that. Right now Bay Ridge, Dyker Heights, Bensonhurst and Midwood are the most racist. So if you wanted to make allot of money just posing as a potential renter in those places as well as certain real estate agents in flatbush you can make allot of money. Just make sure you have a white friend as well to prove different treatment, but most of the time you won't even need it. These people are so racist and ignorant of fair housing laws they won't even knoe what hit them.

Even if this realtor wanted to replace every Black person who moves from an apartment in Flatbush with a white person, there just aren't enough white people in NYC who want to live in Flatbush. Don't flatter yourselves.
